This privacy policy applies to our collection, use, and disclosure of data received or created due to your access to and use of certain items provided by us, Antha Inc. (referred to here as “Antha,” “we,” “us,” or “our”). These items consist of our website at antha.health, and the following services we provide to you: vaginal estrogen therapy and related services. The Site and the foregoing services are referred to collectively as the “Services.” Capitalized terms not otherwise defined in this Privacy Policy have the same meaning as set forth in our Terms of Use.

AS FURTHER DESCRIBED IN THIS POLICY, WE MAY USE COOKIES, PIXELS, AND OTHER TRACKING TECHNOLOGIES, INCLUDING THIRD-PARTY TRACKING TECHNOLOGIES (COLLECTIVELY, “ADTECH”) ON THE SITE. WE USE ADTECH TO COLLECT AND PERFORM DATA ANALYTICS, TO RECORD HOW YOU INTERACT WITH THE SITE AND OUR CONTENT, INCLUDING WHERE YOU DIRECT YOUR MOUSE, THE INFORMATION YOU TYPE, AND OTHER USER-RELATED ACTIVITIES, AND TO SERVE YOU WITH TARGETED ADVERTISING.

Your Consent

By accessing or using the Services, you are consenting to our processing of the information described in this Privacy Policy. “Processing” means using cookies on a computer or mobile device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining, and disclosing information. Information processed by the Services will be transferred, processed, and stored in accordance with United States state and federal law. We will update this Privacy Policy when necessary to reflect material changes in the Services or how we use personal information, and as required by applicable law. If we make material changes to this Privacy Policy, we will provide notice or obtain consent regarding such changes as may be required by law.

What information is collected by the Services and how is it used?

We collect personal information (such as your name, mailing address, email address, phone number, date of birth, and gender) from you when you use the Site and/or submit information to us through the Site (“User Information”). We keep User Information to provide you with the Services. For us to provide you with the Services, it is required that we collect the User Information.

We may also collect government-issued identification (such as driver’s license or passport information) for identity verification purposes, as well as photographs or other content you upload to the Services.

We collect your healthcare information as part of the Services workflow, including information you provide through the patient portal, medical questionnaires, and communications with healthcare providers (“Health Information”). Health Information may include clinical information (such as height and weight, current health conditions, symptom history, and other medical data related to hormone replacement therapy) and non-clinical lifestyle information (such as eating habits and exercise activity). Antha will only use this information as it relates to providing the Services.

In addition, the Site may collect certain information automatically, such as the type of device you use, your device’s unique device ID, the IP address of your device, your operating system, the type of Internet browsers you use, and information about your use of the Site (“Usage Data”). Usage Data will be used by us either individually or in aggregated form to enhance and improve the Site.

We may also collect geolocation data depending on your device and app settings when you use our Services. Additionally, we infer new information from other data we collect, including using automated means to generate information about your likely preferences or other characteristics (“Inferences”). For example, we infer your general geographic location based on your IP address.

A note about Cookies: Cookies are pieces of information stored directly on the device that you are using. Cookies allow us to collect information such as browser type, time spent on our Site, pages visited, language preferences, and other anonymous traffic data. We and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, and to personalize your experience while using the Site. We also use cookies to gather statistical information about use of the Site in order to continually improve its design and functionality, to understand how it is used, and to assist us with resolving questions regarding it.

Web beacons (also called single-pixel or clear GIFs) are electronic images contained within a website or email. When your browser opens a webpage or email that contains a web beacon, it automatically connects to the web server that hosts the image. This allows that web server to log information about your device and to set and read its own cookies. We may include web beacons in our email messages or newsletters to tell us if you open and act on them.

We may also use cookies and similar technologies for advertising purposes. Among other uses, these cookies limit the number of times you may see our advertisements, and help us measure the effectiveness of our outreach campaigns. The advertising or social media networks that we work with place these cookies on our behalf. They may track that you have visited this Website, and we then share this information with the advertising network, either automatically, or manually (this practice is sometimes referred to as “retargeting”). We may use information that we collect from you to contact you or send you information, for example, to send you our newsletters, marketing or promotional materials, and other information that we think may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or the instructions provided in any email we send.

Cookie and Browser Controls: Most web browsers are set to accept cookies by default. If you prefer, you can go to your browser settings to learn how to delete or reject cookies. If you choose to delete or reject cookies, this could affect certain features or services of our website. If you choose to delete cookies, settings and preferences controlled by those cookies, including advertising preferences, may be deleted and may need to be recreated.

Some browsers and browser extensions support the “Global Privacy Control” (GPC) or similar controls that can send a signal to the websites you visit indicating your choice to opt-out from certain types of data processing, including data sales and/or targeted advertising, as specified by applicable law. There is not a common understanding of how to interpret the DNT signal; therefore, our website does not respond to browser DNT signals. Instead, you can use the range of other tools to control data collection and use, including the GPC, cookie controls, and advertising controls described above.

Android and iOS operating systems provide options to limit tracking and/or reset the advertising IDs on your mobile device.

Do third parties see and/or have access to information obtained by the Services?

User Information and Usage Data may be shared with the third-party service providers who host and support the Site on Antha’s behalf. These service providers do not have any right to independently use any personal information that we share with them. For example, companies we have hired to provide customer service support or assist in protecting and securing our systems and services may need access to personal information to provide those functions.

We only use and disclose Health Information in accordance with applicable law, including the Health Insurance Portability and Accountability Act (“HIPAA”) where applicable. To the extent Antha is deemed a “business associate” of a healthcare provider (including both IMGs, Antha may be subject to certain provisions of HIPAA with respect to “protected health information” as defined under HIPAA. We only share Health Information with third parties who have entered into a written Business Associate Agreement (“BAA”) and only for the purposes of providing you with the Services. Any medical or health information that you provide that is subject to specific protections under applicable state laws will be used and disclosed only in accordance with such applicable laws.

Marketing and Advertising Partners

As described in more detail above, we may provide personal information to marketing and advertising partners. For example, we may disclose identifying information to an advertising partner in order to deliver personalized advertising to you or for the purpose of delivering advertisements to other people with similar interests to you. Third-party analytics and advertising companies also collect personal information through our website and apps, including identifiers and device information (such as cookie IDs, device IDs, and IP address), geolocation data, usage data, and inferences based on and associated with that data. These third-party vendors may combine this data across multiple sites to improve analytics for their own purposes and others.

Affiliates

We may enable access to personal information across our subsidiaries, affiliates, and related companies, for example, where we share common data systems or where access helps us to provide our Services and operate our business.

Corporate Transactions

We may disclose personal information as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or a transfer, divestiture, or sale of all or a portion of our business or assets.

Legal and Law Enforcement

We will access, disclose, and preserve personal information when we believe that doing so is necessary to: (a) comply with applicable law or respond to valid legal process, including from law enforcement or other government agencies; (b) protect our customers and others, for example to prevent spam or attempts to commit fraud, or to help prevent the loss of life or serious injury of anyone; (c) operate and maintain the security of our Services, including to prevent or stop an attack on our computer systems or networks; or (d) protect the rights or property of ourselves or others, including enforcing our agreements, terms, and policies.

Payment Processors

We may provide paid products and/or services within the Site. In those cases, we work with third-party service providers to perform payment processing on our behalf (e.g., payment processors).

We will not store or collect your payment card details. Information that you provide to our third-party payment processors is governed by their privacy policies. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. By submitting payment information, you grant Antha without charge the irrevocable, unencumbered, universe-wide, and perpetual right to provide such information to third parties (e.g., payment processing companies) for the purpose of facilitating the transaction.

What are my opt-out rights?

We only collect the User Information, Usage Data, and Health Information that is necessary to provide you with the Services. Because of this, the only way to opt out of information collection is by stopping your use of the Services and not visiting the Site. If you do not wish to receive marketing emails from us, you can opt out of future marketing emails by following the instructions provided in the marketing emails. Opting out of marketing emails will not affect our administrative emails to you (e.g., emails about your transactions or policy changes). These choices do not apply to certain informational communications including surveys and mandatory service communications.

Data retention policy

We retain personal information for as long as necessary to provide the Services and fulfill the transactions you have requested, comply with our legal obligations, resolve disputes, enforce our agreements, and for other legitimate and lawful business purposes. Because these needs can vary for different data types in the context of different services, actual retention periods can vary significantly based on criteria such as user expectations or consent, the sensitivity of the information, the availability of automated controls that enable users to delete data, and our legal or contractual obligations. We retain personal information about you for as long as you use the Site or consume the Services, and for a reasonable period after you stop using the Site.

Your Personal Information Rights

You may make certain requests regarding our use of your personal information by contacting us using the information provided at the end of this Privacy Policy. We will respond to verifiable requests within the timeframes required by applicable law. For your protection, we may need to verify your identity before acting on your request. To verify your request, we may ask you to send it from the email address associated with your account or require you to provide information necessary to verify your account.

We provide a variety of ways for you to control the personal information we hold about you, including choices about how we use that data. These controls and choices may be enforceable as rights under applicable law, including the California Consumer Privacy Act (CCPA) and similar state privacy laws.

  • Right to Know and Access. You may request that we disclose to you the personal information we have collected about you. You also have a right to request additional information about our collection, use, disclosure, or sale of such personal information. We will provide a copy or a summary of your information, usually within 45 days of your request. We may charge a reasonable, cost-based fee for additional copies.
  • Right to Correct. You may request that we correct inaccurate personal information about you. In your request, please make clear what personal information you would like to have changed. We may decline the request if we cannot verify your identity, the request is unreasonable or excessive, or as otherwise permitted by applicable law, but we will tell you why in writing.
  • Right to Delete. You may request that we delete personal information about you that we have collected, subject to certain exceptions required or permitted by law. We may decline deletion requests where retention is necessary to complete a transaction, detect security incidents, comply with legal obligations, or for other purposes permitted by applicable law.
  • Right to Opt-Out of Sale or Sharing. You have the right to opt-out from future “sales” or “sharing” of personal information as those terms are defined under applicable state privacy laws, including the CCPA. Note that the CCPA defines “sell,” “share,” and “personal information” broadly, and some of our data sharing described in this Privacy Policy may be considered a “sale” or “sharing” under those definitions. To exercise this right, please contact us using the information provided below or use the Global Privacy Control. This opt-out right does not apply to personal information that we share with third-party service providers involved in the operation of the Site.
  • Right to Limit Use of Sensitive Personal Information. You have a right to limit our use of sensitive personal information for any purposes other than to provide the services or goods you request or as otherwise permitted by law. To opt-out from such additional purposes, please contact us or use the Global Privacy Control.
  • Right to Data Portability. You may request a copy of your personal information in a portable, readily usable format to the extent technically feasible.
  • Right to Designate an Authorized Agent. You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your privacy rights. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us.
  • Right to Non-Discrimination. You have a right to not be discriminated against for exercising the privacy rights described in this section.

We may decline requests in certain cases as permitted by applicable law. For example, we may decline requests where granting the request would be prohibited by law, could adversely affect the privacy or other rights of another person, would reveal a trade secret or other confidential information, or would interfere with a legal or business obligation. If you receive a response from us informing you that we have declined your request, in whole or in part, you may appeal that decision by contacting us using the information provided at the end of this Privacy Policy.

California Privacy Rights

If you are a California resident, the rights described above in “Your Personal Information Rights” are provided to you under the California Consumer Privacy Act (CCPA). This section provides additional information specific to California residents.

Notice at Collection. At or before the time of collection, you have a right to receive notice of our practices, including the categories of personal information and sensitive personal information to be collected, the purposes for which such information is collected or used, whether such information is sold or shared, and how long such information is retained. This Privacy Policy is intended to serve as our notice at collection.

“Shine the Light” Law. Under California Civil Code section 1798.83, also known as the “Shine the Light” law, California residents who have provided personal information to a business with which the individual has established a business relationship for personal, family, or household purposes may request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes. Please be aware that we do not disclose personal information to any third parties for their direct marketing purposes as defined by this law. California residents may request further information about our compliance with this law by contacting us using the information provided at the end of this Privacy Policy.

Minors. We do not knowingly sell or share the personal information of minors under 16 years of age.

Age Requirements

The Site is not designed or intended to appeal to minors and we do not knowingly collect User Information from children under the age of 13. Users of our Site must be at least 18 years of age and legally competent to enter into and agree to our Terms of Use. As a tool for providing the Services, users may enter Health Information related to minors where a parent or guardian has consented to use of the Services with that individual. It is your responsibility to make sure that consent from the parent or guardian is collected and documented. If we obtain actual knowledge that we have collected personal information through the Site from a person under thirteen (13) years of age, we will use reasonable efforts to refrain from further using such personal information or maintaining it in retrievable form.

If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at support@antha.health so we can promptly delete such information. Furthermore, if you are under sixteen (16) years of age, then you (or your parent or legal guardian if you are under age 13) may at any time request that we remove content or information about you that is posted on the Site. Please submit any such request to support@antha.health with a subject line of “Removal of Minor Information.” For each request, please clearly state the nature of your request, the identity of the content or information to be removed, the location of the content on the Site, your name, address, and email address.

Security

We are concerned about protecting the confidentiality of all information that we interact with in providing the Services. We and our service providers make use of physical, electronic, and procedural safeguards to protect the information that we process and maintain. We strive to use reasonable physical, technical, and administrative measures to protect information from unauthorized access, use, disclosure, alteration, and destruction. Although we endeavor to provide security for the information that we process and maintain based on the sensitivity of that information, no security system can prevent all potential security breaches. However, you must keep your account password secure and your account confidential, and you are responsible for any and all use of your account.

In addition to the security safeguards we provide, we urge you to take precautionary measures in maintaining the integrity of your data. Please be responsible for making sure that no one can see or access your account or log-in/password information, or your mobile device. To help us protect personal information, we request that you use a strong password and never share your password with anyone or use the same password with other sites or accounts. The Site may contain links to other sites or services that are not operated by us. If you click an outside link, you will be directed to that outside site or service. Changes

We reserve the right to modify this Privacy Policy at any time in our sole discretion by including such alteration and/or modification in this Privacy Policy, along with a notice of the effective date of such modified Privacy Policy. If we make material changes to this Privacy Policy, we will provide notice or obtain consent regarding such changes as may be required by law. Any continued use by you of the Site after the posting of such modified Privacy Policy shall be deemed to indicate your agreement to such modified Privacy Policy.
